Terms of Service & Beta Program Agreement
Please read these Terms of Service carefully before creating an account or using the My Boudoir Portal platform. By creating an account, you agree to be bound by these terms in their entirety.

ALL SALES ARE FINAL. My Boudoir Portal does not offer refunds of any kind, including partial refunds, prorated refunds, or refunds for unused portions of any billing period. By completing your purchase or beginning your free trial with a valid payment method on file, you acknowledge and agree that all charges are final and non-refundable. This policy applies to all subscription tiers, beta program fees, and any other charges associated with your My Boudoir Portal account.
As used in these Terms of Service, the following definitions apply:
By creating an account, entering a payment method, beginning a free trial, or using any portion of the My Boudoir Portal platform, you represent that you have read, understood, and agree to be bound by these Terms of Service in their entirety, as well as our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these terms, you must not create an account or use the Platform. Your continued use of the Platform following any modification to these terms constitutes your acceptance of the modified terms.
You represent that you are at least 18 years of age and have the legal authority to enter into this agreement on behalf of yourself or, if applicable, the business entity you represent.
Free Trial. My Boudoir Portal offers a 3-day free trial period. A valid payment method is required to begin the free trial. You will not be charged during the trial period. If you do not cancel your account before the trial period ends, your payment method will be charged for your first full billing period at the applicable subscription rate.
Subscription Tiers. My Boudoir Portal offers three subscription tiers: Portal Only ($14.00/month), Portal + Gallery Reveal ($69.00/month), and Full System ($119.00/month). Pricing is subject to change with 30 days written notice to active subscribers.
Billing Cycle. Subscriptions are billed monthly. There are no annual subscription plans available at this time. Your subscription renews automatically on the same calendar day each month unless cancelled.
All Sales Are Final. All subscription fees charged to your payment method are final and non-refundable. This includes charges for the first billing period following your free trial, all subsequent billing periods, and any partial billing periods. My Boudoir Portal does not offer prorated refunds for cancellations made mid-billing-period. Upon cancellation, you retain access to the Platform through the end of your current paid billing period.
Cancellation. You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period. You will not be charged for subsequent billing periods following cancellation.
Failed Payments. If a payment fails, My Boudoir Portal will attempt to collect payment using the payment method on file. If payment cannot be collected within 7 days of the due date, your account may be suspended. Suspended accounts retain their data for 30 days, after which the account and associated data may be permanently deleted.
Chargebacks. Initiating a chargeback or payment dispute for any My Boudoir Portal charge constitutes a material breach of these Terms of Service. In the event of a chargeback, My Boudoir Portal reserves the right to immediately terminate your account, pursue collection of the disputed amount plus any fees incurred as a result of the chargeback, and report the dispute to payment networks as permitted by applicable law.
My Boudoir Portal operates on a self-hosted architecture that requires you to create and maintain your own account with a third-party cloud storage provider. By using the Platform, you acknowledge and agree to the following:
Ownership. You retain full ownership of all Studio Content you upload or transmit through the Platform. By using the Platform, you grant My Boudoir Portal a limited, non-exclusive license to process, transmit, and display your Studio Content solely as necessary to provide the services described herein.
Responsibility. You are solely responsible for all Studio Content and for ensuring that your use of the Platform complies with all applicable laws and regulations, including those governing the photography, storage, and distribution of intimate images.
Prohibited Use. You may not use the Platform to upload, store, transmit, or display any content that is unlawful, involves minors in any capacity, violates any person's right to privacy, or was obtained without the informed consent of the subject. Violation of this provision will result in immediate account termination without refund.
Client Consent. You represent and warrant that you have obtained all necessary consents from your clients to upload, store, and display their images and personal information through the Platform.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOUDOIR SUITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, OR ANY OTHER DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF BOUDOIR SUITE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BOUDOIR SUITE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO BOUDOIR SUITE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
My Boudoir Portal does not guarantee uninterrupted or error-free operation of the Platform. Scheduled maintenance, unexpected outages, or third-party service failures do not entitle you to a refund or credit of any kind.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BOUDOIR SUITE DOES NOT WARRANT THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.
My Boudoir Portal reserves the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms of Service, including but not limited to failure to pay, prohibited use, chargeback initiation, or conduct that My Boudoir Portal determines in its sole discretion to be harmful to the Platform, other users, or third parties.
Upon termination for cause, you will not be entitled to any refund of amounts previously paid. Your cloud storage account and the files contained within it remain your property and are unaffected by termination of your My Boudoir Portal account.
These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms of Service or your use of the Platform shall first be submitted to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Pennsylvania. Each party shall bear its own costs and attorneys' fees unless the arbitrator awards otherwise.
You waive any right to bring a class action lawsuit or class-wide arbitration against My Boudoir Portal.
My Boudoir Portal reserves the right to modify these Terms of Service at any time. Material changes will be communicated to active subscribers via email at least 14 days prior to taking effect. Your continued use of the Platform following the effective date of any modification constitutes your acceptance of the modified terms.
This Beta Program Agreement applies specifically to photographers who join the My Boudoir Portal Beta Program and is incorporated into and made part of the My Boudoir Portal Terms of Service.
Beta Discount. Beta program participants receive a 50% discount on their subscription fee for the first three (3) full billing months following the end of their free trial period. After the third billing month, the subscription automatically renews at the full standard rate for the selected tier. No further action is required by My Boudoir Portal to end the beta discount — it expires automatically.
Program Cap. The beta program is limited to ten (10) photographers. Once ten accounts have been created under the beta program, the beta discount will no longer be available to new subscribers regardless of when they sign up.
Feedback Obligation. In exchange for the beta discount, participants agree to actively use the Platform with real clients and to report any bugs, errors, unexpected behaviors, or usability issues to My Boudoir Portal within 48 hours of discovery. Feedback may be submitted through the support channel provided at signup.
Beta Product Acknowledgment. By joining the beta program, you acknowledge that My Boudoir Portal is a new platform that may contain bugs, errors, or incomplete features. You agree to use the Platform with an understanding of this risk. My Boudoir Portal's standard limitation of liability applies in full during the beta period. The existence of bugs or incomplete features during the beta period does not entitle you to a refund.
All Sales Are Final. The beta discount does not modify the no-refund policy stated in these Terms of Service. All charges collected during and after the beta period are final and non-refundable.
Removal from Beta Program. My Boudoir Portal reserves the right to remove a participant from the beta program for failure to provide feedback, misuse of the Platform, or violation of any provision of these Terms of Service. Removal from the beta program does not entitle the participant to a refund of amounts already paid, but does terminate the beta discount going forward.
