Please read and agree to the following terms. This takes about 3 minutes and protects both of us.
Your agreement with My Boudoir Portal, a product of Boudoir Automations, a brand of Moonlight and Lace Boudoir LLC.
These Terms of Service ("Terms") constitute a binding legal agreement between you ("Photographer," "Subscriber," or "you") and Moonlight and Lace Boudoir LLC, operating under the brand Boudoir Automations and its product My Boudoir Portal ("MBP," "we," "us," or "our"), located at 47 W. Main St., Waynesboro, PA 17268.
By creating an account, you confirm you have read, understood, and agree to be bound by these Terms in full. If you do not agree, do not create an account.
My Boudoir Portal provides a white-label client portal platform designed for professional boudoir photographers. The platform includes access to branded client-facing portal pages, photographer dashboard tools, and associated features based on your selected subscription plan. Features available to you depend on your current plan tier. We reserve the right to modify, add, or remove features at any time with reasonable notice.
You must be at least 18 years of age and a professional photographer to use this platform. By creating an account you confirm that all information you provide is accurate, current, and complete. MBP is a B2B platform intended solely for professional business use. It is not intended for use by end consumers or photography clients.
MBP operates on a recurring subscription basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel prior to the renewal date. You authorize us to charge your payment method on file for all subscription fees.
New subscribers receive a 7-day free trial. A valid payment method is required to start the trial. If you do not cancel before the end of your 7-day trial period, your payment method will be charged the applicable monthly subscription fee beginning on day 8.
Beta program participants receive 50% off the standard monthly subscription price for their first 3 months. The discount applies automatically to months 1, 2, and 3 of the active subscription following the trial period. Beginning with month 4, the subscription automatically renews at the full standard price without further notice. Promotional pricing is temporary and your subscription will automatically renew at the standard rate following the promotional period.

All subscription payments are non-refundable. If you cancel your subscription, you will retain access to the platform through the end of your current paid billing period. No prorated refunds will be issued for partial months or unused time. Exceptions may be considered on a case-by-case basis solely at our discretion and do not create a precedent for future requests.
You may cancel your subscription at any time through your account settings or by contacting us at hello@boudoirautomations.com. Cancellation takes effect at the end of your current billing period. Upon cancellation, your access to the platform and all associated tools will be terminated. It is your sole responsibility to export or backup any data, content, or files before cancellation. We are not responsible for data loss following account termination.
You retain full ownership of all content, images, branding, and client data you upload or configure within the platform. You grant MBP a limited, non-exclusive license to store and serve that content solely for the purpose of operating the platform on your behalf. You are solely responsible for all content you upload, configure, or make accessible through the platform. MBP does not access, sell, or share your client data with third parties except as required to operate the service or as required by law.
You agree not to use MBP to distribute illegal, harmful, or obscene content involving minors; violate any applicable law or regulation; attempt to reverse-engineer, copy, or resell the platform or its underlying code; circumvent any security or access controls; share account credentials with unauthorized third parties; or use the platform in a way that harms the reputation or operations of MBP. Violation of this section may result in immediate account termination without refund.
We strive for high availability but do not guarantee uninterrupted access to the platform. MBP shall not be liable for any damages resulting from platform unavailability. We do not offer service level agreements or uptime guarantees unless expressly provided in a separate written agreement.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOONLIGHT AND LACE BOUDOIR LLC, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, CLIENTS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM. In no event shall our total liability to you for any claims exceed the total amount you paid to MBP in the three (3) months immediately preceding the claim.
You agree to indemnify, defend, and hold harmless Moonlight and Lace Boudoir LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
All platform code, design, templates, tools, and MBP branding remain the exclusive intellectual property of Moonlight and Lace Boudoir LLC. You are granted a limited, non-transferable license to use the platform during your active subscription. You may not copy, reproduce, resell, or distribute any portion of the platform or its underlying systems.
Any dispute arising from these Terms shall first be addressed through good-faith negotiation by contacting us at hello@boudoirautomations.com. If a resolution cannot be reached within 30 days, disputes shall be resolved through binding arbitration in Franklin County, Pennsylvania under the American Arbitration Association's Commercial Arbitration Rules. You waive any right to participate in class action litigation against MBP.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
We reserve the right to update these Terms at any time. Material changes will be communicated via email with at least 14 days notice. Continued use of the platform following notice of changes constitutes your acceptance of the updated Terms.
How we collect, use, and protect the information associated with your account.
My Boudoir Portal is a product of Boudoir Automations, a brand of Moonlight and Lace Boudoir LLC, 47 W. Main St., Waynesboro, PA 17268. Contact: hello@boudoirautomations.com. This Privacy Policy applies to photographers who subscribe to MBP. It does not govern the data your end clients provide to you through your branded portal — you are responsible for your own privacy practices with your clients.
Account Information: When you sign up, we collect your name, email address, studio name, URL handle, phone number, and website. Payment data is processed by Stripe and is never stored on our servers.
Platform Configuration Data: We store the branding settings, content, and configurations you input into your photographer dashboard.
Usage Data: We may collect technical data such as login times, browser type, IP address, and feature usage for platform security and improvement.
Communications: If you contact us via email or support, we retain those communications for customer service purposes.
We do not collect, access, or store personal data belonging to your photography clients. Your end clients' images, personal information, and session data are stored in your own cloud storage environment, not ours. You are the data controller for your clients' information. We are a data processor acting solely on your behalf.
We do not use your information for advertising. We do not sell your data. Ever.
We do not share your data with any other third parties except as required by law.
We take reasonable technical and organizational measures to protect your account data, including encrypted storage, access controls, and secure transmission protocols. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at hello@boudoirautomations.com if you suspect unauthorized access.
We retain your account data for as long as your subscription is active. Following account cancellation or termination, we may retain certain data for up to 90 days for backup and legal compliance purposes. It is your responsibility to export any data you wish to keep before cancelling your account.
You have the right to access, correct, or request deletion of your account data at any time by contacting hello@boudoirautomations.com.
You are responsible for maintaining your own privacy policy and obtaining appropriate consent from your photography clients for any data you collect through your branded portal. MBP is not responsible for your clients' data or your compliance with applicable privacy laws as they relate to your photography business.
The MBP platform is intended for use only by professional photographers who are 18 years of age or older. We do not knowingly collect personal information from individuals under 18.
We may update this Privacy Policy from time to time. Material changes will be communicated via email with at least 14 days notice.
